Highland Pointe was created in multiple phases, each phase having its own set of covenants. There have been multiple attempts to consolidate these covenants over the years through Association membership drives. While most permanent members today will fall under Phase 5 covenants, there are still homes beholden to covenants for Phases 1-4, meaning rules might not apply consistently across all Highland Pointe homes. These Amended and Restated Covenants and Bylaws will permit the consolidation of multiple phase covenants as well as bring outdated clauses up to modern scrutiny, allowing the Association to conduct business more efficiently and on par with standard business practices of today. In order to pass these amended and restated documents, there will need to be a 2/3 vote of eligible Association members. Voluntary pay members are bound by Highland Pointe covenants and bylaws but are not allowed to vote on them per Article I, Section 6 of the Highland Pointe bylaws.

The Highland Pointe Board of Directors provided input to the Association's legal counsel, Lazega and Johanson, who in turn wrote the Amended and Restated Covenants and Bylaws. Counsel used current covenants as a basis, along with the 2018 draft, current HOA law, state law, and federal laws to draft these documents that are up for vote. Board members also provided Lazega and Johanson with information on common resident complaints, day to day business needs and processes, and challenges with execution of the rules or lack thereof in the existing covenants. Lazega and Johanson are a legal firm that specialize in HOA law, one of few in the state of Georgia. Considerable time and expense was devoted to updating these documents, confirming eligible voters, and preparing and mailing out voting materials.
